Word Climb Terms of Use

These terms are an agreement between you and the independent developer of Word Climb ("we", "us"). By downloading or playing Word Climb, you agree to them. If you do not agree, please do not use the app. If you got the app from Google Play, the Google Play Terms of Service also apply. If you got it from the Apple App Store, section 12 also applies.

1. Your licence to play

We give you a personal, non-exclusive, non-transferable and revocable licence to install and use Word Climb on devices you own or control, for your own non-commercial entertainment.

2. What you may not do

• Copy, modify, sell, rent or distribute the app or its content.
• Reverse-engineer, decompile or tamper with the app, except where the law allows it.
• Cheat, exploit bugs, or use bots or modified versions of the app to get stars, power-ups or other in-game items.
• Interfere with the ads, or use the app for anything unlawful.

3. Stars and in-game items

Stars, power-ups (hints, undos, reveals and extra time) and other in-game items are part of the game. They have no real-world value, cannot be exchanged for money or anything else of value, cannot be transferred, and are not your property: you have a licence to use them in the game. We may change how they are earned, priced or used to keep the game balanced.

Your progress is stored only on your device. It can be lost if you reset your progress, clear the app's data, uninstall the app or change devices, and we cannot restore it.

4. Ads

The app is free and supported by ads. Optional ads give you stars after the ad finishes. How many you can watch is limited, and an ad is not always available. Ads are provided by third parties. We are not responsible for their content or for the products they advertise. Our Privacy Policy explains how ad data is handled.

5. Purchases

You can buy star packs, Remove Ads and a one-time Starter Pack. They are sold through Google Play (or the App Store) under that store's terms, at the price the store shows before you pay, and refunds follow the store's refund policy and the law.

• Star packs add stars to your balance. Stars are kept on your device and are used up when you spend them.
• Remove Ads turns off the ads shown between puzzles. Optional ads you choose to watch for stars stay available.
• The Starter Pack can be bought once. Its stars and power-ups are added straight away, and its ad-free days start when you buy it.

Remove Ads and the Starter Pack are tied to your store account and can be restored after a reinstall or on a new device with Restore Purchases. Stars and power-ups are not restored: like the rest of your progress, they are lost if you reset your progress or uninstall the app. Purchases are final except where the store's policy or the law says otherwise.

6. Ownership

Word Climb, including its code, design, artwork, name and puzzles, belongs to us or our licensors and is protected by law. Third-party components are used under their own licences, listed in Settings > About > Licenses. The game's word list is a curated subset of the public-domain ENABLE word list.

7. Updates and availability

We may update, change or stop offering the app or any feature at any time. Some updates may be needed to keep playing. We work to keep the game running smoothly, but we do not promise that it will always be available or free of errors.

8. Disclaimer

The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some places do not allow these exclusions, so they may not apply to you.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or in-game items, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the laws of your country.

10. Ending these terms

You can stop using the app at any time by uninstalling it. We may end your licence if you break these terms. Sections 3, 6, 8, 9 and 11 continue to apply after the terms end.

11. General

If any part of these terms cannot be enforced, the rest still applies. These terms are governed by the laws of the place where the developer is established, without regard to its conflict-of-law rules, unless the mandatory consumer laws of the country where you live give you more protection. We may update these terms. If we do, we will update the effective date and show the new terms in the app. If you keep playing after a change, you accept the new terms.

12. Apple App Store

If you use Word Climb on an Apple device:

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for handling any claims about the app, including product liability claims, claims that the app does not meet legal or regulatory requirements, consumer protection claims, or claims that the app infringes someone else's intellectual property.
• You confirm that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
